General Terms and Conditions

1. Definitions

In these terms and conditions the following definitions apply:

HotelsInColombia: HotelsInColombia B.V. a private limited liability company incorporated under the laws of the Netherlands, having its offices at Amstelvlietstraat 267, 1096 GG Amsterdam, the Netherlands and registered with the Chamber of Commerce in Amsterdam under number 50938991.

Hotel: Hotels that are members of HotelsInColombia.

User: a natural person who may access the website to obtain information and contract the services offered through the website.

2. Application

By making use of this website and/or all services of HotelsInColombia and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement).

Application of conditions other than these terms and conditions is explicitly rejected by HotelsInColombia.

3. Scope of our Service

This website has been compiled with the greatest care by HotelsInColombia. The information on this website has been compiled to offer information about hotels in Colombia so that Users can directly book a Hotel online. This website is only meant to help you determine the availability of a Hotel and for making desired bookings.

HotelsInColombia acts as an intermediate and only forwards your booking to the Hotel. The booking itself is a transaction between the Hotel and the User who makes the booking. HotelsInColombia will send you a confirmation email for and on behalf of the Hotel. Hotel has the right to refuse a booking.

The information that we disclose on our website is based on the information provided to us by the hotels. Each Hotel remains responsible at all times for the accuracy, completeness and correctness of the information (including the rates and availability) displayed on our website.

4. Privacy

HotelsInColombia respects your privacy. Your personal details for completing your booking with the Hotel of your choice, will not be disclosed to third parties without your consent, except if this is required by law in any relevant jurisdiction. The Privacy Statement explains which data are processed, how your data is used and what your rights are.

5. User obligations

You guarantee that you are legally entitled to enter into contracts and that you will use this website in accordance with these terms and conditions. You also declare that you have sufficient means and the authority to act for your activities on this website. Furthermore, you guarantee that all the information which is given by you with regard to the use of this website is true and correct. You agree the website and the services offered through this website are only used to make legitimate reservations and not for any unlawful purpose.

6. Free of charge

The use of the services of HotelsinColombia is free of charge: HotelsinColombia does not charge a reservation fee or administration fees, nor does HotelsInColombia charges you for cancellations and changes to your booking(s). HotelsinColombia does not charge your credit card, as you will pay the hotel directly for your stay.

7. Credit card

Unless otherwise stated in the room description (for example in case of Special Deals etc.), your credit card details are used only to guarantee your booking at the Hotel. We will therefore send your credit card details directly to the Hotel you booked. Your credit card details are immediately deleted by HotelsInColombia as soon as your booking has been sent to the Hotel. No money will be deducted from your credit card account at the time of making the booking. Full payment must be made directly at the Hotel during the check-in procedure.

After your booking has been processed it is normal procedure for the hotel to carry out a pre-authorization check on the credit card to ensure that the card is valid and that sufficient funds are available to guarantee the reservation. Hotel has the right to cancel your reservation and to notify you of the cancellation by email. The Hotel takes precautions in case you fail to cancel your booking in time, or if you do not take up your booking without cancelling it in advance (no show).

8. Cancellation

Should you wish to cancel your reservation, you can only do so by navigating to "My Booking" and entering your reservation number. Each Hotel has its own cancellation and no-show policy.

The general cancellation and no-show policy of each Hotel is made available on our website at the hotel information page and in the confirmation email. Cancellations made within the time limit given by the Hotel will be free of charge. If you cancel beyond the cancellation deadline or do not arrive at the Hotel (no-show), the Hotel has the right to charge you a cancellation fee. A booking is only cancelled if you have received an email confirming the cancellation. Certain special offers are not eligible for cancellation. We recommend you read the cancellation and no-show policy of the Hotel carefully prior to making your reservation.

9. Exchange rate

Hotel rates are denominated in the currency of the country you are visiting. Rates in other currencies are for information purposes only and should not be relied upon as accurate and real time. Exchange rates are calculated on the basis of public resources and are not updated on a daily basis. Exchange rates can change every day.

10. Intellectual property

The intellectual property rights, including copyrights, of all information which you will find on this website rests with HotelsInColombia. Freely reusing, duplicating and/or distribution of the information offered on this website is not allowed without the prior written consent of HotelsInColombia.

11. Disclaimer

HotelsInColombia cannot be held liable on the basis of contract, tort, neglect, legal duty or any other basis for loss or damage of any kind arising from or in connection with the use or function of the website, including - but not limited to - a loss resulting from non delivery or delayed delivery of electronic messages, interception or manipulation of electronic messages by third parties or by software/hardware used for electronic communication and transmitting viruses.

HotelsInColombia does not guarantee that the information about participating hotels offered on this website is correct and complete, which information is provided by the hotels themselves, who are for that reason also responsible for the correctness of this information. If you want to recover any loss that you have suffered as a result of incorrect descriptions of a Hotel or mistakes in the hotel's availability dates, you need to contact the Hotel in question directly.

When you book a Hotel through our website, it is your responsibility to inform HotelsInColombia should you not receive a confirmation email. This usually occurs as a result of a strong junk mail filter or an incorrectly entered email address.

Any consequential loss which results from wrongful payments to a Hotel or wrongful credit card charges by a Hotel are the responsibility of the Hotel in question. HotelsInColombia cannot be held liable for this loss.

HotelsInColombia does not accept any liability for unavailability of rooms caused by the hotel overselling its own room inventory.

By using the website of HotelsInColombia you indemnify HotelsInColombia against all losses resulting from claims by third parties resulting from violation or noncompliance with these terms and conditions, or against claims which are otherwise connected with or result from your use of this website.

12. Modification

HotelsInColombia reserves the right to modify the terms and conditions under which this website is offered.

13. Applicable law

HotelsInColombia is registered in the Netherlands and Dutch laws applies to this organisation. All disputes resulting from the use of this website and for which HotelsinColombia can be held liable, should be brought before the court in Amsterdam which is declared competent.
